Assess your FMSB application before filing

A foreign money services business has no place of business in Canada but directs and provides covered services to clients in Canada. That can include an overseas remittance company, foreign exchange provider or virtual currency business. Registration in your home country does not replace the Canadian requirement. FINTRAC's MSB and FMSB criteria explain how the distinction works.

Being a non-resident founder does not automatically make your company an FMSB. A business with a Canadian place of business may follow the domestic route instead. We review your entity, operating presence, customer markets and service delivery before recommending Canadian MSB registration or an FMSB application.

Canadian representative for service and application documents

The FMSB application requires a representative for service who resides in Canada and is authorised to accept FINTRAC notices and inquiries on the foreign business's behalf. The role differs from the compliance officer who manages your AML program; the application should clearly identify both responsibilities. The FMSB remains responsible for meeting its obligations.

You also need entity and governance records, ownership and management information, service descriptions and the required criminal record documentation. We help you organise the submission and identify translation requirements against FINTRAC's official FMSB application checklist.

Canadian AML compliance for an overseas business

An existing foreign AML policy may not describe the Canadian obligations or your actual Canadian customer flow. We review what needs to be adapted: onboarding, risk assessment, record keeping, monitoring, reporting and training. Your compliance officer needs procedures the team can use across the jurisdictions in which it operates.

Our AML compliance program service and outsourced CAMLO and MLRO support can be coordinated with registration. Payment businesses should also assess whether RPAA registration with the Bank of Canada applies to their retail payment activities.

Prepare your FMSB registration from abroad

Start with your current corporate records, ownership chart, home-country registrations and a description of how you attract and serve Canadian customers. We use these to identify missing information and keep your application, compliance policies and customer-facing business model consistent.

Preparation, translation, compliance and professional support are separate budget items. We scope the work around your entity and services rather than treating every foreign application as the same project. Read our guide for foreign founders for more on the two routes and the practical questions to resolve before filing.

Frequently asked questions

The foreign MSB route is for businesses without a place of business in Canada that direct and provide covered services to Canadian clients. Incorporating a Canadian company is a different route; your actual operating presence determines which assessment is appropriate.

No. A representative for service must reside in Canada and be authorised to accept FINTRAC notices and inquiries for the FMSB. The compliance officer oversees the AML compliance program. These responsibilities must be addressed separately.

A foreign business dealing in virtual currency that directs and provides services to clients in Canada can fall within the FMSB framework. Securities and other requirements must be assessed separately for its business model.
